Article I. Nature of Services
The Company provides a marketing and advertising platform designed to assist property owners in promoting real estate for sale. The Company may also provide general educational information.
The Company is not a real estate broker, agent, or intermediary and does not provide brokerage services, legal advice, representation, negotiation, or transaction management.
Article II. No Brokerage or Agency Relationship
Use of the Platform does not create any agency, fiduciary, or brokerage relationship between the Company and any user. All transactions occur directly between buyers and sellers. The Company is not a party to any transaction.
Article III. No Legal or Professional Advice
The Company does not provide legal, tax, or financial advice. Users are strongly encouraged to consult with a licensed real estate attorney and other professionals before entering into any real estate transaction.
Article IV. User Responsibilities
Users are solely responsible for:
- Accuracy of listings and information
- Compliance with applicable laws
- Negotiating and executing contracts
- Completing all transaction steps including closing
The Company does not verify listing accuracy or ownership.
Article V. Listings and Content
Users may submit property listings and related content. By submitting content, you represent that:
- You have the legal right to post the content
- The information is accurate and not misleading
- The content does not violate any law
The Company may remove or modify content at its discretion.
Article VI. Fees and Payments
All fees for listings, promotions, or subscriptions are non-refundable unless otherwise stated in writing. The Company reserves the right to modify pricing at any time.
Article VII. No Guarantee of Results
The Company does not guarantee:
- That a property will sell
- The timing of any sale
- Any specific price or outcome
Article VIII. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any damages arising from:
- Real estate transactions between users
- Inaccurate listings
- User conduct
- Use of the Platform
Use of the Platform is at your own risk.
Article IX. Indemnification
You agree to indemnify and hold harmless the Company and its owners, managers, and agents from any claims arising out of:
- Your use of the Platform
- Your listings or content
- Your real estate transactions
- Your violation of these Terms
Article X. Intellectual Property
All content on the Platform (excluding user content) is owned by the Company and may not be used without permission.
Article XI. Termination
The Company may suspend or terminate access to the Platform at any time for any reason.
Article XII. Dispute Resolution
Any disputes shall first be resolved through mediation in Tennessee. If unresolved, disputes shall be settled by binding arbitration in Tennessee.
Article XIII. Governing Law
These Terms shall be governed by the laws of the State of Tennessee.
Article XIV. Changes to Terms
The Company may update these Terms at any time. Continued use of the Platform constitutes acceptance of any changes.
